Boxly is a platform that connects you with independent moving and related service providers. We are not a moving company.

Welcome to Boxly! These Terms of Service (“Terms”) govern your access to and use of our services, website, mobile app, and any related platforms (collectively, the “Services”). By registering, booking, or using Boxly, you agree to be bound by these Terms.

1. Eligibility

  • You must be at least 18 years old to use Boxly.
  • By using Boxly, you confirm that you have the legal authority to enter into this agreement.

2. Our Services

  • Boxly connects users with independent movers, packers, and related service providers (“Partners”).
  • Boxly is not a moving company. We act as a platform to facilitate connections.
  • Services may include moving, packing/unpacking, assembly/disassembly, cleaning, or related tasks.

3. Booking & Payment

  • Prices are shown upfront and include estimated service costs. Final charges may vary based on time, labour, and scope.
  • Payments must be made securely through the Boxly platform.
  • All fees are non-refundable except as outlined in our Cancellation & Refund Policy.

4. Insurance & Liability

Partners are independent contractors who are responsible for maintaining their own insurance. Boxly itself does not provide insurance and is not an insurer.

Partners are responsible for exercising reasonable care in handling items. However, they are not responsible for damage to the contents of sealed or pre-packed boxes, or for issues that could not have been reasonably observed at the time of handling.

Users are fully responsible for ensuring that items are properly packed, secured, and protected unless packing services have been booked through Boxly.

Excluded Items:

Partners and Boxly will not be liable for fragile goods (including glass, mirrors, and artwork), valuables (such as jewelry, watches, collectibles, cash, bonds, and securities), hazardous materials (including chemicals, flammable items, and explosives), weapons (including firearms, ammunition, knives, or similar), illegal drugs or substances, perishable goods, plants, or animals. Users must not include such items in any move under any circumstances.

Appliances and Electronics:

Boxly and Partners will not be responsible for the internal functioning of appliances and electronics (e.g., refrigerators, washing machines, microwaves, toasters, televisions, computers) after a move, unless there is clear and documented physical damage caused during handling or transport. Pre-existing faults or failures are the sole responsibility of the user.

Missing Items:

Boxly and Partners will not transport or handle cash, jewelry, essential documents, or similar valuables under any circumstances. Responsibility for such items remains entirely with the customer, and they must not be included in any move.

Claims: Any claims for loss or damage must be submitted in writing within 72 hours of service completion.

5. Cancellations

  • Users may cancel bookings according to our Cancellation Policy (linked separately).
  • No-shows (including failing to answer calls on moving day, not being present at the agreed-upon pickup or drop-off location, or being otherwise unreachable) or late cancellations may incur full charges.

6. User Responsibilities

  • Provide accurate information (addresses, item details, photos).
  • Be present (or ensure an authorized person is present) at pickup and drop-off.
  • Not request illegal, hazardous, or prohibited item transport.
  • Ensure parking, building access, elevator reservations, and any required permits are arranged in advance.
  • Prepare items for safe handling (disconnected appliances, emptied refrigerators, secured drawers).
  • Accurately disclose fragile or oversized items that may require special handling.
  • Confirm that no excluded items (valuables, weapons, hazardous goods, cash, documents, drugs) are included in the move.
  • Report any issues or damages promptly through Boxly's support process.
  • Represent and warrant that you have legal ownership of, or authority to move, all items scheduled for transport.

7. Partner Responsibilities

  • Partners are responsible for their conduct, equipment, and work quality.
  • Partners are independent contractors, not employees of Boxly.
  • Partners must maintain valid licenses, insurance, and compliance with laws.

8. Prohibited Uses

You agree not to:

  • Misuse the platform (fraud, scams, false bookings).
  • Attempt to bypass Boxly by hiring Partners outside the platform.
  • Upload harmful, unlawful, or misleading content.

9. Limitation of Liability

  • Boxly is not liable for indirect, incidental, or consequential damages.
  • Boxly's total liability will not exceed the lesser of (a) the amount paid for the specific booking in question, or (b) CAD $100.

10. Dispute Resolution

  • Disputes between users and Partners must first be attempted through Boxly support.
  • If unresolved, disputes will be governed by the laws of Alberta, Canada, with exclusive jurisdiction and venue in the courts of Calgary, Alberta. Users agree to first attempt binding mediation or arbitration before proceeding to court.

11. Account Suspension & Termination

  • Boxly reserves the right to suspend or terminate accounts that violate these Terms, or at Boxly's sole discretion if we believe it is necessary for safety, security, legal, or business reasons, including if we decide we no longer wish to provide services to a user.
  • Users may delete accounts at any time.
  • No compensation, refund, or damages of any kind will be owed to users whose accounts are suspended or terminated by Boxly.
  • Any outstanding unpaid balances remain due even if an account is suspended or terminated.

12. Changes to Terms

  • Boxly reserves the right to update these Terms at any time. When material changes are made, we will notify users by posting an updated version on our website or app, and where feasible, by email or in-app notification.
  • Users are encouraged to check these Terms regularly.
  • Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

13. Force Majeure

Boxly and its Partners will not be liable for delays, failures, or inability to perform caused by events beyond their reasonable control, including natural disasters, severe weather, government actions, strikes, labour disputes, internet or power outages, or other force majeure events.

14. Privacy Compliance

Boxly complies with Canadian privacy law (PIPEDA). Details of how we collect, use, and protect personal information are set out in our Privacy Policy.
